In Texas, as in many states, for privately-owned severed surface and mineral estates, the surface owner unquestionably owns the right to grant a subsurface easement for an off-lease penetration point. Federal minerals, not so much. Are we prepared for a shift in the regulatory landscape affecting our subsurface operations on federal lands? In a decision that could reshape the landscape of federal mineral rights, the True Oil LLC v. Bureau of Land Management case has sparked significant debate and discussion.
