Royalty Receiverships
WHAT DO YOU DO WHEN YOU WANT TO LEASE A TRACT OF LAND OR PAY ROYALTIES, BUT THE OWNER IS NOWHERE TO BE FOUND?
If a mineral or royalty owner is truly unlocatable, Texas law provides a mechanism to appoint a Receiver to either negotiate a lease covering the missing owner’s interest or to receive royalty payments on their behalf. But before a Receiver can be appointed, the lessee is going to have to meet a number of legal hurdles to demonstrate good faith.
